Duties of a Texas Process Server
A certified Texas process server's core duties center on the lawful, neutral, and well-documented service of judicial process. The basic duties include:
- Personal service. Hand-delivering citations, subpoenas, and other court documents to the named party whenever the rules require it.
- Alternative service when authorized. Using substitute service, service by posting, or service by publication only when ordered by the court or permitted by rule.
- Diligence. Making reasonable, timely attempts and accurately recording each attempt — date, time, address, observations.
- Neutrality. Remaining impartial; never coaching, intimidating, or providing legal advice to any party.
- Return of Service. Filing a complete, truthful Return of Service so the court can determine whether the named party received notice.
- Compliance. Following the Texas Rules of Civil Procedure, JBCC rules, and any court order governing the service.
